This paper will look at how Aunt Ella’s Pie Company can avoid violating any legal laws through Human Resource Manager’s creating policies resulting in best practice. The EEOC is responsible for enforcing federal laws that make it illegal to discriminate against a job applicant or an employee because of the person s race, color, religion, sex (including pregnancy, gender identity, and sexual orientation), national origin, age (40 or older), disability or genetic information (U.S. EEOC, 2014). Unionized Employees Employee-employer relationship regarding employees who are members of a union will have union representation to warrant a cause versus a non-union employee when it comes to employment-at-will doctrine. The bakers, sales staff and warehouse workers would have the right to have union negotiate their employment. While the union members will have security when it comes to pay, hours, work compensation, employees are subject to termination due policy violation as the cause as justification. Since Aunt Ella’s Pie Company has employees working seven (7) days and fifty (50) hours a week, during busy times, the business faces possible allegation of unfair practices in wages. Employee must receive wages for each day worked and at time and a half above 40 hours per week. A lawsuit will cost the company a larger settlement due to violation of failing to issue overtime pay, then if the employees received proper wages. Harassment and Discrimination Companies should include freedom from discrimination from recruiting, to hiring and during employment on the application, in the policy handbook and as staff meetings.
